An Albion man police say was driving drunk when he crashed his car and killed his passenger last year in China has been indicted on charges of manslaughter and operating under the influence.
Bruce K. Bourget II, 50, was allegedly behind the wheel when he was unable to make a turn on Neck Road in China on April 16, 2022, and the 2006 Chevy Cobalt he was driving rolled over several times. The crash ejected him and his passenger, Peter S. Fernald Jr., 63, of Winslow. Fernald was taken by LifeFlight of Maine helicopter to Eastern Maine Medical Center in Bangor, where he died.
A Kennebec County grand jury recently indicted Bourget on a Class A felony count of manslaughter, as well as Class B criminal operating under the influence, also a felony. The manslaughter charge alleges Bourget “did recklessly, or with criminal negligence, cause the death of another human being, Peter S. Fernald Jr.” The charge carries a maximum sentence of up to 30 years in prison.
Bourget was critically injured in the crash and taken by ambulance to MaineGeneral Medical Center in Augusta.
After the accident, a Kennebec County Sheriff’s Office news release stated police believed “alcohol and speed may have been contributing factors in the crash.”
Sheriff’s deputies responded to a report of a rollover crash at 12:23 a.m. on April 16, 2022. Fernald died of his injuries suffered in the crash at the hospital just before 6 a.m. that morning.
An indictment is not a determination of guilt, but it indicates there is enough evidence to proceed with formal charges and a trial.
