L.D. 829, “Resolve, To Complete the Timely and Appropriate Redesign of Shared Living Services for Adults with Intellectual Disabilities or Autism”: emergency bill, requires the Department of Health and Human Services to continue to work on the redesign of its shared living program and to complete the redesign by June 30, 2013.

L.D. 897, “ An Act To Establish the Volunteer Advocate Program”: establishes in law the Volunteer Advocate Program to replace the Volunteer Correspondent Program.

L.D. 969, “Resolve, Directing the Department of Health and Human Services To Reduce and Limit the Adult Developmental Services Waiting Lists by Implementing a More Efficient, Responsive and Individualized Model of Service Delivery”: emergency bill, requires the Department of Health and Human Services to request approval from the federal Centers for Medicare and Medicaid Services to amend the MaineCare waivers to permit the reimbursement for the use of appropriate electronic technology as a means of reducing the costs of supporting people currently being served.

L.D. 1453, “An Act To Increase the Transparency of Charges and Expenses of Hospitals That Receive State Funding”: requires the Maine Health Data Organization to conduct an annual study of hospital financial data and establishes the Commission to Study Transparency, Costs and Accountability of Health Care System Financing.

L.D. 1466, “An Act To Amend the Law Governing Provider Contracts with Insurance Companies”: places certain requirements on contracts for preferred provider arrangements, which are contracts between a health insurance carrier and a health care provider in which the provider agrees to provide services to a health plan enrollee whose plan benefits include incentives for the enrollee to use the services of that provider.

L.D. 1485, “An Act Relating to Insurance Company Formation and Dissolution”: updates references to Maine domestic insurance company “certificates of organization” in the Maine Insurance Code to “articles of incorporation”; simplifies and reduces the number of filings that must be made by those either forming or dissolving Maine insurers; and clarifies the procedure for the secretary of State, the superintendent of Insurance and insurers to follow with respect to certificates of dissolution.

L.D. 125, “An Act To Preserve Lender Equity in the Foreclosure Process”: reduces the filing fee for foreclosure actions to $150; prohibits a fee for mediation from being assessed; and makes clear that a court may enter summary judgment in a foreclosure action at any time.

L.D. 392, “An Act To Protect Homeowners and Reduce Foreclosure Fraud”: requires that a plaintiff seeking to foreclose on a mortgage is required, upon request of the defendant within 90 days of service of the foreclosure summons and complaint, to produce the original mortgage note, evidencing that the plaintiff has the right to foreclose.

L.D. 612, “An Act To Protect Owners of Property in Foreclosure from Accumulation of Debts When Mortgagees Refuse To Complete the Foreclosure Process”: emergency bill, requires owners of foreclosed property who vacate their homes after receiving notice of a foreclosure judgment to notify the attorney representing the mortgagee in the foreclosure and the municipal tax assessor of the municipality where the mortgaged premises are located that they have vacated the property within 30 days of vacating the mortgaged premises.

L.D. 784, “An Act To Impose Penalties for Residential Mortgage Loan Fraud and False Representation Concerning Title”: establishes civil and criminal penalties for those persons engaging in residential mortgage loan fraud and making a false representation concerning title.

L.D. 807, “An Act To Provide Protection to a Condominium Association When a Condominium Is Foreclosed On”: amends the Maine Condominium Act to create a definition of “priority amounts.”

L.D. 851, “An Act To Require the Return of Excess Funds by a Municipality That Forecloses on Real Estate”: requires the municipality, to provide notice of the availability of the excess funds, after subtracting the tax lien, interest, fees for recording the lien, costs of mailing notice, court costs and any other expenses incurred in disposing of the real estate, to the former owner within 30 days of sale of the real estate or 180 days of the foreclosure, whichever is sooner.

L.D. 1116, “An Act To Amend the Attorney’s Fees Provision in Foreclosure Actions”: provides that if the mortgagee does not prevail in a foreclosure action or if the court finds the action was not brought in good faith, then the court must order the mortgagee to pay reasonable attorney’s fees and court costs to the mortgagor.

L.D. 1389, “An Act To Expedite the Foreclosure Process”: allows an employee of a financial institution or credit union who is not an attorney to appear for that institution in connection with a foreclosure action.

L.D. 1354, “An Act To Create the Aging in Place Program”: establishes the Aging in Place Program in the Department of Economic and Community Development to assist low-income seniors with aging in place and establishes the Aging in Place Fund and appropriates money to the fund.

L.D. 1451, “An Act To Require the Membership of the State Workforce Investment Board To Include Representatives of the Local Workforce Investment Boards”: requires that the membership of the State Workforce Investment Board include a representative from each of the local workforce investment boards in this state.

L.D. 1458, “An Act To Enact the Maine Small Business Investment Protection Act”: enacts the Maine Small Business Investment Protection Act to protect franchisees in the sale and operation of franchise businesses.

L.D. 1482, “An Act To Amend the Motor Vehicle Franchise Laws”: defines “essential tool”; provides a fair supply and mix of vehicles; and clarifies that when a manufacturer requires a dealer to purchase a special or essential tool a manufacturer may charge only its actual cost for such a tool.

L.D. 1268, “An Act To Update Driver Education Requirements”: clarifies that an instruction permit may be issued only by the secretary of State; requires that the accompanying driver be at least 25 years of age; and provides that a person under 21 years of age may not apply for a license unless the person has completed 70 hours of driving, including 10 hours of night driving, while accompanied by a parent, guardian or licensed driver at least 25 years of age.

L.D. 1392, “An Act To Amend the Motor Vehicle Laws”: removes the provision of law that allows the Secretary of State to issue vanity plates for radio plates as these plates now qualify as vanity plates; changes the headnote for the provision governing antique vehicle plates to “hobbyist registration plates”; and increases the fee for the Purple Heart motorcycle vanity plate to $25. It also clarifies  that the Secretary of State is allowed to receive law enforcement intelligence and investigative information; adopts federal definitions from the federal Commercial Motor Vehicle Safety Act of 1986 pertaining to commercial motor vehicle operation; and adds foster relationships to the definition of an immediate family member.

L.D. 1460, “An Act To Update and Clarify the Laws Governing the Operation of Bicycles on Public Roadways”: amends and clarifies the laws regarding bicycles by clarifing current laws and definitions.

L.D. 1464, “An Act To Streamline the Laws Related to Transportation”: affords the Department of Transportation more flexibility to grant exceptions to the prohibition against allowing access to controlled access highways; amends transit-related provisions related to public transportation administration; and directs the Department of Transportation to work with the Office of Policy and Legal Analysis and the Revisor of Statutes to develop recommendations regarding reorganizing or updating.

L.D. 1465, “An Act To Increase Accountability and Efficiency of Independent Entities Involved in Separate Aspects of the State’s Transportation Systems”: proposes to consolidate under one agency those independent agencies and quasi-governmental agencies that are established under state law and that are involved in or manage, control or oversee separate aspects of the state’s transportation systems.

L.D. 1467, “Resolve, To Establish a Demonstration Project To Promote Economic Development in the Forest Products Industry”: requires the commissioner of Transportation to establish a demonstration project in the Town of Ashland for the purpose of demonstrating cost-effective ways of promoting economic development in the forest products industry.
