I am writing today to draw attention to L.D. 1862, an Act to Strengthen Maine’s Good Samaritan Laws Concerning Drug-related Medical Assistance. The proposal to the current law would further protect non-violent offenders from being arrested or prosecuted when seeking medical assistance or who are present during a drug-related emergency, for a violation of probation or conditions of release. Furthermore, this proposal defines “violent crimes” to avoid ambiguity.

The benefit of this proposed legislation is all inclusive, with the ultimate goal of keeping people alive. According to the National Survey on Drug Use and Health, 45% of Americans suffer from a dual diagnosis. This population would be positively impacted from this legislation by decreasing the fear to call for help due to the risk of being arrested. Many suffer severe consequences from of the current stigma around mental health disorders and substance use and consequently cannot get the help they need. This act aims to reduce the stigmas around mental health disorders and ultimately to save lives.

My hope is to see this act pass, strengthening trust between community members, first responders, police and Maine citizens. Together we can make a difference.
