FARMINGTON — A Wilton man was sentenced Jan. 9 to serve 30 days of a one-year sentence for eluding police in Chesterville last July.
Theodore Fischer, 28, pleaded guilty in Franklin County Superior Court to a felony charge of eluding an officer and a misdemeanor charge of operating while license suspended or revoked.
Assistant District Attorney Joshua Robbins said if the case had gone to trial Sgt. Nathan Bean of the Franklin County Sheriff’s Department would have testified that he had his cruiser lights and siren on when he attempted to stop Fischer’s speeding truck on Pope Road in Chesterville.
The truck stopped near the Chesterville Corner Store on Dutch Gap Road, and Bean ordered the driver to get out. Instead, the driver sped off and crashed the truck on Ridge Road near the intersection with Horseshoe Pond Road.
The driver fled on foot while a passenger stayed at the scene. Bean and his police dog, Bain, followed tracks into the woods but did not find the driver, Sheriff Scott Nichols Sr. said previously.
Fischer turned himself in to Bean the following morning.
Robbins said Fischer’s license had been suspended for failure to pay child support.
Active-Retired Justice Thomas Delahanty II asked Fischer to remain current on child support, but Fischer said he has custody of his child.
After Fischer is released from the county jail, he will serve two years of probation. He was ordered to pay a $500 fine on the suspended license charge.
