ALFRED — Attorneys for the prosecution and defense concluded presenting their evidence today in the murder trial of Patrick Dapolito.

Both sides are expected to present their closing arguments when the trial resumes on Thursday.

Dapolito, 41, is accused in the 2010 killing of his wife, 30-year-old Kelly Winslow.

He initially told authorities that Winslow was accidentally killed when the gun he was holding while asleep fired.

The defense now says that Winslow was the victim of a dispute betwee Dapolito and his associates in his marijuana distribution business.

In court action this morning the prosecution concluded its cross examination of Dapolito.

Justice John O’Neil also ruled that any expert testimony for the defense by a former federal Drug Enforcement Administration agent would be limited.

James Nims’ DEA career included posts in Texas and Mexico. Dapolito has testified that his dispute involved a supplier based in Magnolia, Texas.

But the defense ultimately did not call Nims to testify.
